Terms of Service

These Terms govern your access to and use of Nola, including our mobile app, website, and related services.

1. Agreement to These Terms

By accessing or using Nola, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

You must be at least 13 years old to use Nola. If you have not reached the age of legal majority where you live, you may use Nola only with permission from a parent or legal guardian.

2. The Nola Service

Nola provides tools for recording, organizing, and reviewing personal financial activity. Features may include transaction entry, budgeting, reports, exports, shared groups, and optional AI-assisted processing of text, images, or audio.

Features and availability may change over time. We may add, modify, limit, suspend, or discontinue part of the service when reasonably necessary for product, security, legal, or operational reasons.

3. Your Account

You agree to provide accurate information, maintain the security of your sign-in method, and promptly notify us if you suspect unauthorized access. You are responsible for activity conducted through your account unless applicable law provides otherwise.

Nola is intended for personal use. You may not create accounts through unauthorized automated means, impersonate another person, or use credentials you are not authorized to use.

4. No Financial or Professional Advice

Nola is an organizational and productivity tool. It is not a bank, payment service, credit bureau, financial adviser, accountant, broker, tax adviser, or law firm. Nothing in Nola constitutes financial, investment, tax, accounting, or legal advice.

Budgets, summaries, classifications, reports, and other outputs depend on the information available to the service and may be incomplete, delayed, or inaccurate. You remain responsible for verifying important information and for any financial decisions or filings you make.

5. AI-Assisted Features

AI-assisted features are provided for convenience. They may misread, omit, duplicate, or incorrectly classify information. You must review results before saving, exporting, or relying on them. Do not use AI output as a substitute for original financial records or professional advice.

You are responsible for ensuring that you have the right to submit content for processing and for avoiding unrelated confidential or sensitive information.

6. Subscriptions, Trials, and App Store Billing

Certain features may require a paid subscription. Purchases made in the iOS app are billed and managed by Apple under the terms shown in the App Store and at checkout.

  • Prices, billing periods, and any trial terms are displayed before purchase.
  • A subscription renews automatically unless it is cancelled before renewal.
  • You can manage or cancel a subscription through your Apple account settings.
  • A free trial, if offered, converts to a paid subscription unless cancelled before it ends.
  • Refund requests and billing disputes for App Store purchases are handled by Apple under its policies.

We may change subscription offerings or prices prospectively, with any notice or consent required by Apple or applicable law.

7. Your Content

You retain ownership of content you submit to Nola. You grant us a limited, non-exclusive license to host, reproduce, process, adapt, and transmit that content only as reasonably necessary to operate, secure, support, and improve the service.

You represent that you have the necessary rights to submit the content and that doing so does not violate law or another person's rights. Content intentionally submitted to a shared or community feature may be visible to its intended audience. We may review, restrict, or remove content that violates these Terms or threatens the service or its users.

8. Acceptable Use

You may not:

  • Use Nola unlawfully or infringe the rights of others.
  • Access another person's account or data without authorization.
  • Probe, bypass, or interfere with security, authentication, usage limits, or service availability.
  • Upload malicious code or use the service to distribute harmful, fraudulent, or abusive content.
  • Scrape, reverse engineer, or automatically access the service except where expressly permitted by law or by us.
  • Use Nola to develop or train a competing product without our written permission.
  • Resell or commercially exploit the service unless we have authorized it in writing.

9. Third-Party Services

Nola may rely on or link to third-party services, including sign-in providers, Apple's App Store, infrastructure providers, analytics, and AI processing services. Their products and processing may be governed by separate terms and privacy policies.

We are not responsible for third-party services outside our reasonable control. However, this does not limit any responsibility we have under applicable law for the providers we use to operate Nola.

10. Nola Intellectual Property

Nola, excluding your content, and its software, designs, branding, text, graphics, and other materials are owned by or licensed to us and protected by applicable intellectual property laws. Except for the limited right to use the service under these Terms, no rights are granted to you.

11. Disclaimer of Warranties

To the maximum extent permitted by law, Nola is provided "as is" and "as available." We disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing or usage of trade.

We do not warrant that the service will always be available, secure, uninterrupted, or error-free, or that any content or result will be complete or accurate. Some jurisdictions do not permit certain disclaimers, so they may not apply to you.

12. Limitation of Liability

To the maximum extent permitted by law, Nola and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from or related to the service.

To the maximum extent permitted by law, our total liability for all claims relating to the service will not exceed the greater of US$100 or the amount you paid for Nola during the 12 months before the event giving rise to the claim. These limitations do not exclude liability that cannot lawfully be excluded or limited, and your jurisdiction may provide additional rights.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold Nola and its operator harmless from third-party claims, damages, and reasonable expenses arising from your unlawful misuse of the service, your violation of these Terms, or content you submit that infringes another person's rights. This obligation does not apply to the extent a claim results from our own conduct.

14. Suspension, Termination, and Account Deletion

You may stop using Nola or request account deletion at any time. We may suspend or terminate access when reasonably necessary to address a violation of these Terms, security or abuse risk, legal requirement, or material operational harm. Where appropriate, we will provide notice or an opportunity to remedy the issue.

Deleting your Nola account does not cancel your Apple subscription. Billing may continue until you cancel the subscription in your Apple account settings.

Provisions that by their nature should survive termination, including ownership, disclaimers, limitations of liability, and dispute provisions, will remain in effect.

15. Governing Law and Disputes

These Terms are governed by the laws of Mexico, without regard to conflict-of-law principles. Before filing a formal claim, you and Nola agree to attempt in good faith to resolve the dispute by contacting the other party, unless immediate relief is reasonably necessary.

Subject to any mandatory consumer protection rights or other jurisdictional requirements, disputes will be submitted to the competent courts of Nuevo León, Mexico.

16. Changes to These Terms

We may update these Terms as Nola evolves or legal requirements change. We will post the updated Terms, revise the date above, and provide additional notice of material changes when appropriate. Your continued use after updated Terms take effect constitutes acceptance to the extent permitted by law.

17. General Terms

If any provision is found unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a business reorganization or transfer. These Terms and the Privacy Policy form the entire agreement between you and Nola regarding the service.
